WorkSafe NZ Enforcement Undertaking- Project Management
An Enforceable Undertaking is an agreement between WorkSafe NZ and a duty holder made
under the Health and Safety at Work Act 2015 (HSWA). It is entered into voluntarily by the duty
holder following a breach (including an alleged breach) of HSWA and, once in place, is legally
binding.

Event Investigations
When an adverse event occurs, too often, the focus is on identifying the individual or team's
failures. This directs the corrective actions to “fixing” these individuals with performance
management, training, or discipline.
Investigating is a specialist skill. A deep dive to determine what happened and why the event occurred moves the focus from “who has failed, to what (system) has failed”, resulting in effective recommendations to prevent future harm.

When a near miss or serious harm event occurs, WorkSafe NZ may ask you to carry out a Duty
Holder Review. This is a structed self-review that helps you to learn what caused the event
and what can you do to prevent another similar event occurring.
